1. PURPOSE AND SCOPE
These Terms of Service (“Terms”) govern your access to our website and the provision of counselling, bodywork, and group education services by Tūāhu Wellness. By engaging our services or using this website, you agree to be bound by these Terms.
2. SERVICES OFFERED
Tūāhu Wellness provides the following services for general well-being. These services are provided on a “best efforts” basis and do not constitute clinical psychotherapy or medical treatment.

Individual Counselling (60 minutes): Goal-oriented, behavioural approaches. This service is not trauma-informed, not crisis intervention, and not a substitute for psychiatric treatment. It is unsuitable for severe mental health conditions, including psychosis or acute suicidality.

Bodywork Sessions (90 minutes): Traditional Māori bodywork (Romiromi and Mirimiri). This involves firm pressure to release physical tension. It is not massage therapy, medical treatment, or a diagnostic tool. Please note that bodywork is provided as part of our integrated program.

Integrated Program: An 8-week structured pathway (8 x 60-minute counselling; 4 x 90-minute bodywork). This program is subject to the same professional limitations as defined above.

Group Education (workshops): Group sessions (up to 12 participants). This is not group therapy or crisis support.

Curated Wellbeing Experience: In partnership with Flo₂Flow, we offer an integrated breathwork and regulation experience for your hosted event.
3. WEBSITE USE AND INTELLECTUAL PROPERTY

Ownership: All content on this website (text, images, logos) is owned by Tūāhu Wellness. You may view and print content for personal, non-commercial use only. You must not modify, distribute, or commercialise our content without written permission.

Accuracy: We do not guarantee that website content is error-free, complete, or current. Information is general in nature and not professional advice.

Security: We do not guarantee the website is free from viruses or technical interruptions. You are responsible for configuring your own devices and security software.

Availability: We aim for 24/7 access but may take the site offline for maintenance without notice.
4. BOOKING AND PAYMENT

Confirmation: Appointments are confirmed upon receipt of payment or agreed payment arrangement.

Fees: Fees are published on our website and are subject to change with 30 days’ notice.

Payment Timing: Payment is required prior to the commencement of the appointment.

Late Payment: If payment is not received, we reserve the right to postpone the appointment, charge a $25 late payment fee, or withhold future bookings until the balance is settled.
5. CANCELLATIONS, RESCHEDULING, AND REFUNDS
For full terms, refer to the Cancellation and Refund Policy available on our website. Key terms include a 48-hour notice requirement for all changes and a 100% fee for no-shows.
6. CLIENT RESPONSIBILITIES

Disclosure: You must provide complete and accurate information regarding medical history, medications, injuries, and pregnancy status. Failure to disclose relevant information may impact service safety.

Attendance: You must arrive on time, be in a safe state to engage, and wear appropriate, modest, loose-fitting clothing for bodywork sessions.

Conduct: You must treat practitioners and other group members with respect. Harassment, abuse, or inappropriate behaviour will result in immediate termination of services.

Confidentiality: Information shared in group settings is private. You must not discuss or identify other participants outside the group.
7. CONFIDENTIALITY AND PRIVACY
All session content is confidential, subject to the following exceptions:

Serious risk of harm to yourself or others.

Requirements by law (e.g., court order or mandatory reporting).

Quality assurance via de-identified professional supervision.

Digital Communication: Email and SMS are not secure. Sensitive information should be discussed in-session, not via digital channels.
8. RECORD-KEEPING
Records are retained for at least 7 years post-final session, in alignment with professional guidelines. You have the right to access your records upon written request. A reasonable administrative fee may apply for printing and postage.
9. LIMITATION OF LIABILITY

Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL).

Scope of Liability: To the extent permitted by law, our liability is limited. We are not liable for outcomes resulting from your failure to disclose relevant medical/personal history, failure to follow practitioner guidance, or non-engagement with the service process. Services are provided on an “as is” basis; we do not guarantee specific results.
10. INFORMED CONSENT
By booking, you acknowledge that you understand counselling and bodywork may trigger emotional or physical responses, and that these services are not a substitute for medical or psychiatric care. You are responsible for seeking independent medical advice for health concerns.
11. DISPUTE RESOLUTION
If you have a dispute, contact us in writing within 14 days. We will respond within 10 business days. Unresolved disputes may be escalated to your state’s Office of Fair Trading.
12. ACKNOWLEDGMENT
Our services are available to residents of Australia and most international locations. Due to insurance limitations, we are unable to provide services to residents of the United States of America or its territories and protectorates. By booking, you warrant that you are not accessing these services from the USA or its territories.
By booking or using this website, you acknowledge that you have read, understood, and agreed to these Terms.
